ผู้เช่าต้องเสียค่าใช้จ่ายไปโดยความจำเป็นและสมควรเพื่อรักษาทรัพย์สินซึ่งเช่านั้นเท่าใด ผู้ให้เช่าจำต้องชดใช้ให้แก่ผู้เช่า เว้นแต่ค่าใช้จ่ายเพื่อบำรุงรักษาตามปกติและเพื่อซ่อมแซมเพียงเล็กน้อย
