ผู้ขนส่งจะต้องรับผิดในการที่ของอันเขาได้มอบหมายแก่ตนนั้นสูญหายหรือบุบสลายหรือส่งมอบชักช้า เว้นแต่จะพิสูจน์ได้ว่าการสูญหายหรือบุบสลายหรือชักช้านั้นเกิดแต่เหตุสุดวิสัย หรือเกิดแต่สภาพแห่งของนั้นเอง หรือเกิดเพราะความผิดของผู้ส่งหรือผู้รับตราส่ง
