ผู้ค้ำประกันซึ่งละเลยไม่ยกข้อต่อสู้ของลูกหนี้ขึ้นต่อสู้เจ้าหนี้นั้น ท่านว่าย่อมสิ้นสิทธิที่จะไล่เบี้ยเอาแก่ลูกหนี้เพียงเท่าที่ไม่ยกขึ้นเป็นข้อต่อสู้ เว้นแต่จะพิสูจน์ได้ว่าตนมิได้รู้ว่ามีข้อต่อสู้เช่นนั้น และที่ไม่รู้นั้นมิได้เป็นเพราะความผิดของตนด้วย
