ผู้ค้ำประกันไม่มีสิทธิจะไล่เบี้ยเอาแก่ลูกหนี้ได้ ถ้าว่าตนได้ชำระหนี้แทนไปโดยมิได้บอกลูกหนี้ และลูกหนี้ยังมิรู้ความมาชำระหนี้ซ้ำอีกในกรณีเช่นว่านี้ ผู้ค้ำประกันก็ได้แต่เพียงจะฟ้องเจ้าหนี้เพื่อคืนลาภมิควรได้เท่านั้น
