ถ้าตัวแทนผู้รับมอบอำนาจทั่วไปเห็นเป็นการจำเป็นจะต้องทำการอันใดอันหนึ่งเกินขอบอำนาจที่ได้รับไว้ ต้องขออนุญาตต่อศาล และเมื่อศาลสั่งอนุญาตแล้วจึงจะกระทำการนั้นได้
