ถ้ากิจการอันได้มอบหมายแก่นายหน้านั้นโดยพฤติการณ์เป็นที่คาดหมายได้ว่าย่อมทำให้แต่เพื่อจะเอาค่าบำเหน็จไซร้ ท่านให้ถือว่าได้ตกลงกันโดยปริยายว่ามีค่าบำเหน็จนายหน้าค่าบำเหน็จนั้นถ้ามิได้กำหนดจำนวนกันไว้ ท่านให้ถือว่าได้ตกลงกันเป็นจำนวนตามธรรมเนียม

A broker's remuneration is deemed to have been impliedly agreed upon, if the business entrusted to the broker is, under the circumstances, only to be expected for remuneration. If the amount of the remuneration is not fixed, the usual remuneration is deemed to have been agreed upon.
