ถ้าคู่สัญญาได้กำหนดราคาแห่งมูลประกันภัยไว้ ผู้รับประกันภัยชอบที่จะได้ลดจำนวนค่าสินไหมทดแทนก็แต่เมื่อพิสูจน์ได้ว่าราคาแห่งมูลประกันภัยตามที่ได้ตกลงกันไว้นั้นเป็นจำนวนสูงเกินไปหนัก และคืนจำนวนเบี้ยประกันภัยให้ตามส่วนกับทั้งดอกเบี้ยด้วย
