อันว่าห้างหุ้นส่วนสามัญนั้น คือห้างหุ้นส่วนประเภทซึ่งผู้เป็นหุ้นส่วนหมดทุกคนต้องรับผิดร่วมกันเพื่อหนี้ทั้งปวงของหุ้นส่วนโดยไม่มีจำกัดส่วนที่ ๒ความเกี่ยวพันระหว่างผู้เป็นหุ้นส่วนด้วยกันเอง
