ถ้าผู้ครอบครองขาดยึดถือทรัพย์สินโดยไม่สมัครและได้คืนภายในเวลาปีหนึ่งนับตั้งแต่วันขาดยึดถือหรือได้คืนโดยฟ้องคดีภายในกำหนดนั้นไซร้ ท่านมิให้ถือว่าการครอบครองสะดุดหยุดลง
