ในการวินิจฉัยกรณีความสำคัญผิด กลฉ้อฉล หรือการข่มขู่ให้พิเคราะห์ถึง เพศ อายุ ฐานะ สุขภาพอนามัย และภาวะแห่งจิตของผู้แสดงเจตนาตลอดจนพฤติการณ์และสภาพแวดล้อมอื่น ๆ อันเกี่ยวกับการนั้นด้วย
