ถ้ามิได้ทำหนังสือลงลายมือชื่อของคู่สัญญาแสดงไว้ต่อกันว่าทรัพย์สินที่ให้เช่ามีสภาพเป็นอยู่อย่างไร ท่านให้สันนิษฐานไว้ก่อนว่าผู้เช่าได้รับทรัพย์สินที่เช่านั้นไปโดยสภาพอันซ่อมแซมดีแล้ว และเมื่อสัญญาได้เลิกหรือระงับลง ผู้เช่าก็ต้องส่งคืนทรัพย์สินในสภาพเช่นนั้น เว้นแต่จะพิสูจน์ได้ว่าทรัพย์สินนั้นมิได้ซ่อมแซมไว้ดีในขณะที่ส่งมอบ
