การแสดงเจตนาที่กระทำต่อบุคคลซึ่งมิได้อยู่เฉพาะหน้าให้ถือว่ามีผลนับแต่เวลาที่การแสดงเจตนานั้นไปถึงผู้รับการแสดงเจตนา แต่ถ้าได้บอกถอนไปถึงผู้รับการแสดงเจตนานั้นก่อนหรือพร้อมกันกับที่การแสดงเจตนานั้นไปถึงผู้รับการแสดงเจตนา การแสดงเจตนานั้นตกเป็นอันไร้ผลการแสดงเจตนาที่ได้ส่งออกไปแล้วย่อมไม่เสื่อมเสียไป แม้ภายหลังการแสดงเจตนานั้นผู้แสดงเจตนาจะถึงแก่ความตาย หรือถูกศาลสั่งให้เป็นคนไร้ความสามารถหรือคนเสมือนไร้ความสามารถ

A declaration of intention made to a person not in his presence takes effect from the time when it reached the receiver of the intention. If does not become effective if a revocation reaches him previously or simultaneously. feedback (/form/1-samuiforsale-contact-form.html?tmpl=component) / Even though the person who made a declaration of intention dies, becomes incompetent or quasi- incompetent by an order of the Court after it has been sent, the validity of declaration is not impaired thereby.
