เจ้าหนี้กองมรดกจะบังคับสิทธิเรียกร้องต่อทายาทคนใดก็ได้ แต่ถ้ามีผู้จัดการมรดก ให้เจ้าหนี้เรียกเข้ามาในคดีด้วย
