อันว่าสัญญาประกันภัยนั้น คือสัญญาซึ่งบุคคลหนึ่งตกลงจะใช้ค่าสินไหมทดแทน หรือใช้เงินจำนวนหนึ่งให้ในกรณีวินาศภัยหากมีขึ้น หรือในเหตุอย่างอื่นในอนาคตดังได้ระบุไว้ในสัญญา และในการนี้บุคคลอีกคนหนึ่งตกลงจะส่งเงินซึ่งเรียกว่า เบี้ยประกันภัย
