บุคคลต่อไปนี้จะเป็นพยานในการทำพินัยกรรมไม่ได้(๑) ผู้ซึ่งยังไม่บรรลุนิติภาวะ(๒) บุคคลวิกลจริตหรือบุคคลซึ่งศาลสั่งให้เป็นผู้เสมือนไร้ความสามารถ(๓) บุคคลที่หูหนวก เป็นใบ้ หรือจักษุบอดทั้งสองข้าง
