บุคคลต่อไปนี้จะเป็นผู้จัดการมรดกไม่ได้(๑) ผู้ซึ่งยังไม่บรรลุนิติภาวะ(๒) บุคคลวิกลจริต หรือบุคคลซึ่งศาลสั่งให้เป็นผู้เสมือนไร้ความสามารถ(๓) บุคคลซึ่งศาลสั่งให้เป็นคนล้มละลาย
