เมื่อลูกหนี้ไม่ชำระหนี้ให้ต้องตามความประสงค์อันแท้จริงแห่งมูลหนี้ไซร้ เจ้าหนี้จะเรียกเอาค่าสินไหมทดแทนเพื่อความเสียหายอันเกิดแต่การนั้นก็ได้
