ผู้รับจำนองจะบังคับจำนองแม้เมื่อหนี้ที่ประกันนั้นขาดอายุความแล้วก็ได้ แต่จะบังคับเอาดอกเบี้ยที่ค้างชำระในการจำนองเกินกว่าห้าปีไม่ได้
