เพื่อให้การสืบพยานหลักฐานเป็นไปโดยสะดวก รวดเร็ว และเที่ยงธรรม ประธานศาลฎีกาโดยความเห็นชอบของที่ประชุมใหญ่ของศาลฎีกามีอำนาจออกข้อกำหนดใด ๆ เพิ่มเติมเกี่ยวกับแนวทางการนำสืบพยานหลักฐานได้ แต่ต้องไม่ขัดหรือแย้งกับบทบัญญัติในกฎหมาย
ข้อกำหนดของประธานศาลฎีกาตามวรรคหนึ่ง เมื่อประกาศในราชกิจจานุเบกษาแล้ว ให้ใช้บังคับได้
English translation
In order to make the taking of evidence convenient, speedy and fair, the President of the Supreme Court, with the approval of the plenary session of the Supreme Court, shall have the power to issue any additional regulations concerning the guidelines for adducing evidence, provided that they are not contrary to or inconsistent with the provisions of the law.
The regulations of the President of the Supreme Court under paragraph one, once published in the Government Gazette, shall come into force.

Section 103/3 is a delegated rule-making provision. It authorises the President of the Supreme Court, acting with the approval of the plenary session of the Supreme Court, to issue additional regulations on the guidelines for adducing evidence, aimed at convenience, speed and fairness. The power is bounded: such regulations may not be contrary to or inconsistent with statute, so they operate below and within the Code, not against it. They take legal effect only upon publication in the Government Gazette.
