Article 222/40Vérification et contestation des demandes des membres

English translation

The parties to the case and other group members may request to inspect and object to a debt-repayment claim filed by a group member who has submitted such a claim, but this must be done within thirty days from the date on which the period for filing debt-repayment claims expires, except where there is force majeure, in which case an extension of not more than a further thirty days may be requested.

This provision sits in Part 4 on judgment and execution in class actions and governs the verification stage of the members' debt-repayment claims. Once a member lodges a claim to share in the recovered sum, this section gives the other parties and fellow members a controlled window to scrutinise and challenge it, guarding against inflated or unfounded claims before distribution. The thirty-day period runs from the close of the claim-filing period, and the only ground for extension is force majeure, capped at a further thirty days. It works together with Sections 222/41 and 222/42, which give the execution officer power to examine claims and to rule on those that are objected to.
