Article 340Répartition entre plusieurs créanciers

ในกรณีที่มีเจ้าหนี้ตามคำพิพากษาหลายคนร้องขอให้บังคับคดีแก่ทรัพย์สินของลูกหนี้ตามคำพิพากษาหรือในกรณีตามมาตรา ๓๒๔ เมื่อเจ้าพนักงานบังคับคดีได้ขายทอดตลาดหรือจำหน่ายโดยวิธีอื่นซึ่งทรัพย์สินนั้นเสร็จแล้ว ให้ดำเนินการดังนี้
(๑) หักค่าฤชาธรรมเนียมในการบังคับคดีไว้ แต่ถ้าทรัพย์สินนั้นเป็นของเจ้าของรวม ให้เจ้าพนักงานบังคับคดีกันเงินส่วนของเจ้าของรวมอื่นนอกจากส่วนของลูกหนี้ตามคำพิพากษาออกจากเงินที่ได้จากการขายหรือจำหน่ายทรัพย์สินนั้นเสียก่อน แล้วจึงหักค่าฤชาธรรมเนียมในการบังคับคดีจากเงินเฉพาะส่วนของลูกหนี้ตามคำพิพากษา
(๒) จัดทำบัญชีส่วนเฉลี่ยแสดงจำนวนเงินที่จ่ายให้แก่เจ้าหนี้ตามคำพิพากษาหรือผู้ทรงสิทธิเหนือทรัพย์สินนั้นแต่ละคนจากเงินจำนวนสุทธิที่พอแก่การที่จะจ่ายให้ตามสิทธิของบุคคลเช่นว่านั้นตามบทบัญญัติแห่งประมวลกฎหมายแพ่งและพาณิชย์ ประมวลกฎหมายนี้ หรือกฎหมายอื่นโดยให้แสดงจำนวนเงินที่กันส่วนให้แก่เจ้าของรวมไว้ในบัญชีดังกล่าวด้วย
(๓) ส่งคำบอกกล่าวไปยังลูกหนี้ตามคำพิพากษา เจ้าของรวม และบุคคลตาม
(๒) ขอให้ตรวจสอบบัญชีส่วนเฉลี่ยนั้นและให้ยื่นคำแถลงคัดค้านได้ภายในสิบห้าวันนับแต่วันส่งคำบอกกล่าว
ถ้าไม่มีคำแถลงคัดค้านภายในกำหนดเวลาตาม
(๓) ให้ถือว่าบัญชีส่วนเฉลี่ยดังกล่าวเป็นที่สุด และให้เจ้าพนักงานบังคับคดีจ่ายเงินให้แก่บุคคลตามบัญชีส่วนเฉลี่ยนั้น

English translation

Where several judgment creditors have applied for execution against the property of the judgment debtor, or in a case under Section 324, then, when the execution officer has sold the property by public auction or disposed of it by another method, the officer shall proceed as follows:
(1) deduct the fees of execution; but if the property is jointly owned, the execution officer shall first set aside, from the money obtained from the sale or disposal of that property, the shares of the co-owners other than the share of the judgment debtor, and shall then deduct the fees of execution only from the money in the share of the judgment debtor;
(2) prepare a distribution account showing the amount to be paid to each judgment creditor or holder of a right over that property, out of the net sum sufficient to pay them according to the rights of such persons under the provisions of the Civil and Commercial Code, this Code or any other law, showing in that account also the amount set aside for the co-owners;
(3) send a notice to the judgment debtor, the co-owners and the persons under (2), requesting them to examine that distribution account and to file a statement of objection within fifteen days from the day of service of the notice.
If no statement of objection is filed within the time under (3), the distribution account shall be regarded as final, and the execution officer shall pay the money to the persons according to that distribution account.

Section 340 governs the complex distribution: multiple creditors or a Section 324 claim. It sets a clear sequence: protect co-owners by setting aside their shares first, charge execution fees only against the debtor's share, then prepare a distribution account ranking each creditor and right holder according to the substantive priorities of the Civil and Commercial Code, this Code and other law. Notice to the debtor, co-owners and listed persons opens a fifteen-day objection window under (3); silence makes the account final and triggers payment. It connects forward to Sections 341 and 342, which handle objections and challenges, and to Section 337, which requires the underlying accounts. This is the heart of the ranked-distribution machinery.

Why this matters in practice

If more than one creditor is chasing the same debtor, ranking matters enormously: a secured or preferential creditor is paid before ordinary creditors from the same pool. When you receive the distribution account, examine it carefully and file any objection within fifteen days, because staying silent makes it final. Co-owners of jointly held property should confirm their share was set aside before fees were deducted. Multi-creditor recovery is best handled with a debt collection lawyer in Thailand.
