Article 344 — Surplus proceeds after execution

When every person interested in the execution has received a satisfactory share, if there remains money obtained from the sale or disposal of property after deduction of the execution fees and costs, and such money is subject to being paid to a judgment creditor under Section 329 or is otherwise attached, the executing officer shall pay the remaining money under Section 329 or in accordance with the order attaching the claim, as the case may be.
If the net income obtained from the sale or disposal of property is not required for the continuation of the execution, or if money obtained from the sale or disposal of property remains after deduction of the execution fees and costs and satisfactory payment to all creditors, the executing officer shall pay the net income or the remaining part to the judgment debtor; and if property of a third person had to be disposed of for the benefit of the judgment debtor, the net income or the remaining part shall be paid to that third person.
If any property has been sold under Section 323 and a final judgment has been given in favour of the claimant, the executing officer shall pay the money obtained from the sale to the claimant.

This section closes Part 10 on distribution accounts by directing what happens to any surplus once every claim in the execution has been met. It routes residual proceeds first to creditors entitled under Section 329 or under a separate attachment, and only then back to the judgment debtor, or to a third person whose asset was disposed of. Paragraph three addresses proceeds held from a sale under Section 323, releasing them to the claimant once a final judgment confirms the claim. It works together with Sections 323, 326 and 329 that govern claim contests and rateable distribution.
