In an execution requesting the judgment debtor to return or deliver specific property, the judgment creditor shall be exempt from the executing officer's fee.
The judgment debtor shall be liable for the fees and costs of execution that the judgment creditor has had to pay in the case in which judgment was given to return or deliver specific property, including the fees, costs and execution costs that the judgment creditor has had to pay in another case under Section 347 paragraph two, and these shall be deemed fees, costs and execution costs to be reimbursed to the judgment creditor in the case in which judgment was given to return or deliver the specific property.

This section allocates the financial burden of enforcing delivery judgments. Paragraph one relieves the creditor of the executing officer's fee, recognising that these executions do not realise money for the creditor. Paragraph two shifts the real costs onto the judgment debtor, sweeping in expenses the creditor had to pay in a separate case when claiming the item under Section 347 paragraph two, and characterising all of them as reimbursable costs of the delivery case. It complements Section 347 by ensuring a creditor who navigates a competing execution is not left out of pocket.
