When the court has issued a warrant to arrest the judgment debtor under Section 361, if the judgment debtor appears before the court or is arrested and brought before it, the court has the power to detain the judgment debtor pending consideration of the application until there is a guarantee, or a guarantee and security, as the court considers appropriate.
In the case of a breach of the guarantee contract under paragraph one, the court has the power to order enforcement under the guarantee contract or for the amount that the court considers appropriate, without having to sue the person who made the guarantee contract in a new case.

Section 362 governs the interim stage between arrest and final decision on the Section 361 application. It lets the court detain the debtor pending that decision but provides a release valve: the debtor can secure release by posting a guarantee, or a guarantee and security, on terms the court sets. Paragraph two gives the guarantee real teeth by allowing summary enforcement of a breached guarantee contract without a separate lawsuit, a mechanism echoed in Sections 363 and 366. It sits within Chapter 7 as renumbered by the Amendment Act (No. 30) B.E. 2560 (2017) and works together with the six-month detention cap in Section 363.
