Article 364 — Guarantor who obstructs execution

Where the court has accepted a person as a guarantor and that person intentionally obstructs the execution of the judgment or joins with the judgment debtor in disobeying and failing to comply with the writ of execution, the provisions of Section 361, Section 362, and Section 363 shall apply mutatis mutandis.

Section 364 extends the coercive arrest and detention regime of Chapter 7 to a guarantor who turns against the court's process. Having been accepted as a guarantor, that person owes a duty not to frustrate execution; if they intentionally obstruct it or collude with the debtor in disobedience, the court may treat them like the debtor by applying Sections 361, 362, and 363 mutatis mutandis, including the ex parte arrest procedure, interim detention on guarantee, and the six-month cap. The provision closes an obvious loophole and reinforces that a court guarantee is a serious undertaking. It forms part of Chapter 7 as reorganised by the Amendment Act (No. 30) B.E. 2560 (2017), and links onward to Section 365 on criminal liability.
