Where a party or any person has deposited money, a bank deposit passbook, a bank guarantee letter, or any other security that may be paid in money instead, with the court under the provisions of this Code or by order of the court, such as an order concerning provisional measures before judgment or a stay of execution during an appeal or a further appeal, or in any other case, the judgment creditor in that case is entitled to apply for the court to order the payment of the money, or to take steps to call in the money and pay it to them.
The application and the proceedings under this section are exempt from court fees.

Section 367 closes Chapter 8 and the enforcement Title by dealing with security already lodged with the court. Where money, a bank passbook, a bank guarantee letter, or any security convertible to money has been deposited under the Code or by court order, whether for provisional measures before judgment, a stay of execution pending appeal or further appeal, or any other purpose, the judgment creditor can obtain that value directly by applying for the court to pay it out or call it in. This spares the creditor from separate execution against the deposited fund. Consistent with other enforcement-application provisions such as Sections 359 and 360, the application carries no court fee. It forms part of the enforcement machinery reorganised by the Amendment Act (No. 30) B.E. 2560 (2017).
