ในกรณีที่พยานสำคัญในคดีอาจได้รับภัยอันตรายอันเนื่องมาแต่การปล่อยชั่วคราวผู้ต้องหาหรือจำเลย
พยานนั้นอาจคัดค้านการปล่อยชั่วคราวนั้นได้
โดยยื่นคำร้องต่อพนักงานสอบสวนพนักงานอัยการ หรือศาล แล้วแต่กรณีถ้ามีคำคัดค้านการปล่อยชั่วคราวตามวรรคหนึ่ง
ให้พนักงานสอบสวน พนักงานอัยการหรือศาล แล้วแต่กรณี พิจารณาคำคัดค้านดังกล่าวทันที
โดยให้มีอำนาจเรียกผู้ที่เกี่ยวข้องทั้งสองฝ่ายมาสอบถามเพื่อประกอบการพิจารณาและมีคำสั่งตามที่เห็นสมควร

English translation

In a case where a material witness in the case may be exposed to danger as a result of the provisional release of the accused or defendant, that witness may object to such provisional release by filing an application with the inquiry official, the public prosecutor, or the court, as the case may be. If there is an objection to the provisional release under paragraph one, the inquiry official, the public prosecutor, or the court, as the case may be, shall consider such objection immediately, and shall have the power to summon the persons concerned on both sides for questioning in support of the consideration, and shall issue an order as deemed appropriate.

Firm annotation

Section 108 bis gives a distinct procedural right to a material witness, separate from the parties, to resist the release of an accused whose freedom could put the witness in danger. It fits the bail chapter's concern with the danger factor in Section 108(6) but shifts the initiative to the witness, who may file at whichever stage the case has reached, before the inquiry official, the prosecutor, or the court. The decision-maker must act immediately and may summon both sides for questioning, ensuring the objection is tested rather than simply accepted. It complements witness-protection policy by letting a threatened witness be heard before release is granted.

Why this matters in practice

A witness who fears retaliation should not wait for the parties to act: this section lets the witness object directly, and the official or court must consider it at once. For the accused, it means a bail application in a case with vulnerable witnesses may draw a formal objection that has to be answered on the danger issue.
