คนไทยคนใดกระทำการรบต่อประเทศหรือเข้าร่วมเป็นข้าศึกของประเทศ ต้องระวางโทษประหารชีวิต หรือจำคุกตลอดชีวิต

Firm annotation
This is treason in the narrow sense and it applies to Thai nationals only, which is the element that limits it. Two forms of conduct are covered: waging war against the country, and joining its enemy. The penalty is death or imprisonment for life, with no lesser tier, which places it among the gravest provisions in the Code.

โทษของมาตรานี้มีเพียงประหารชีวิตกับจำคุกตลอดชีวิต การบรรเทาโทษจึงต้องอาศัยบททั่วไป และมาตรา 53 มีผลในทางปฏิบัติ เพราะเมื่อมีการลดโทษจำคุกตลอดชีวิต ให้เปลี่ยนเป็นจำคุกห้าสิบปีก่อน ประเด็นที่ต้องพิสูจน์คือสัญชาติไทยของผู้กระทำ และการกระทำนั้นเป็นการรบต่อประเทศหรือการเข้าร่วมเป็นข้าศึกจริงหรือไม่ ทั้งนี้มาตรา 128 ทำให้แม้เพียงการตระเตรียมการก็ต้องระวางโทษเช่นเดียวกับความผิดสำเร็จ ซึ่งเป็นข้อที่ทำให้ความเสี่ยงเกิดขึ้นเร็วกว่าความผิดทั่วไปมาก ความผิดนี้ยอมความไม่ได้
