ผู้ใดเป็นเจ้าพนักงาน มีหน้าที่ปฏิบัติการให้เป็นไปตามคำพิพากษาหรือคำสั่งของศาล ป้องกันหรือขัดขวางมิให้การเป็นไปตามคำพิพากษาหรือคำสั่งนั้น ต้องระวางโทษจำคุกไม่เกินสามปี หรือปรับไม่เกินหกหมื่นบาท หรือทั้งจำทั้งปรับ หมายเหตุ: [อัตราโทษ แก้ไขเพิ่มเติมโดยมาตรา ๔ แห่งพระราชบัญญัติแก้ไขเพิ่มเติมประมวลกฎหมายอาญา (ฉบับที่ ๒๖) พ.ศ. ๒๕๖๐]

Whoever, being an official having the duty to give effect to a judgment or an order of a court, prevents or obstructs the carrying out of that judgment or order shall be liable to imprisonment not exceeding three years, or a fine not exceeding sixty thousand baht, or both.

Firm annotation
The offender must be an official whose duty is to give effect to a judgment or order of a court, and the conduct is preventing or obstructing that effect. It is the officer inside the system frustrating the court, which is why it sits in the Chapter on offences against judicial officials rather than among the general obstruction provisions. The penalty is up to three years, or a fine of up to 60,000 baht, or both.
