ถ้าผู้กระทำความผิดตามมาตรา ๒๗๖ มาตรา ๒๗๗ มาตรา ๒๗๘ หรือมาตรา ๒๗๙ ได้บันทึกภาพหรือเสียงการกระทำชำเราหรือการกระทำอนาจารนั้นไว้ เพื่อแสวงหาประโยชน์โดยมิชอบสำหรับตนเองหรือผู้อื่น ต้องระวางโทษหนักกว่าที่บัญญัติไว้ในมาตรานั้น ๆ หนึ่งในสาม ถ้าผู้กระทำความผิดตามวรรคหนึ่ง เผยแพร่หรือส่งต่อซึ่งภาพหรือเสียงการกระทำชำเราหรือการกระทำอนาจารที่บันทึกไว้ ต้องระวางโทษหนักกว่าที่บัญญัติไว้ในมาตรานั้น ๆ กึ่งหนึ่ง

Where the offender under Section 276, Section 277, Section 278 or Section 279 has made an image or sound recording of the sexual intercourse or the indecent act in order to obtain an unlawful benefit for himself or for another person, the punishment shall be one third heavier than that prescribed for the offence concerned.
Where the offender under paragraph one disseminates or forwards the image or sound recording so made, the punishment shall be one half heavier than that prescribed for the offence concerned.
