คู่ความฝ่ายที่เกี่ยวข้องอาจร้องขอต่อศาลให้ดำเนินการสืบพยานหลักฐานไปตามวิธีการที่คู่ความตกลงกัน ถ้าศาลเห็นสมควรเพื่อให้การสืบพยานหลักฐานเป็นไปโดยสะดวกรวดเร็ว และเที่ยงธรรม ศาลจะอนุญาตตามคำร้องขอนั้นก็ได้ เว้นแต่การสืบพยานหลักฐานนั้นจะเป็นการไม่ชอบด้วยกฎหมายหรือขัดต่อความสงบเรียบร้อยหรือศีลธรรมอันดีของประชาชน
English translation
The party concerned may apply to the court to conduct the taking of evidence in accordance with a method agreed upon by the parties. If the court sees it as appropriate, so as to make the taking of evidence convenient, speedy and fair, it may grant such application, unless the taking of evidence would be unlawful or contrary to public order or good morals.

Section 103/2 gives the parties freedom to shape the evidence process by agreement, subject to the court's control. On the application of a party, the court may allow evidence to be taken by a method the parties have agreed, provided this serves convenience, speed and fairness. The one hard limit is legality: the court must refuse any agreed method that is unlawful or contrary to public order or good morals. Together with Sections 103/1 and 103/3, it reflects the Code's move toward more flexible, party-driven evidence handling while preserving judicial oversight and the fairness baseline of Section 103.
Why this matters in practice
If both sides prefer a streamlined or unconventional way to present evidence, for example agreed written statements, a fixed running order, or a particular use of documents, you can put that agreement before the court under Section 103/2. Frame it around convenience, speed and fairness, since those are the grounds the court weighs, and make sure nothing in the method is unlawful or offends public order or good morals, or the court must reject it. A clear, written agreement on scope helps the court say yes and prevents disputes mid-trial.
