English translation
When a witness has given testimony, whether that witness was summoned or was brought by a party, the witness is discharged from any further duty to remain at the court, unless the court has ordered the witness to wait for such period as the court may fix.

Firm annotation
Section 109 sets the point at which a witness's duty of attendance ends. After giving testimony, the witness, whether summoned under Section 106 or brought voluntarily by a party, is released from any further obligation to remain at court. The court retains a discretion to require the witness to wait for a fixed period, for example where recall, confrontation with another witness, or further examination may be needed. The rule spares witnesses from open-ended waiting once their evidence is complete, while preserving the court's control over the conduct of the hearing.
Why this matters in practice
Let your witnesses know they can usually leave once their evidence is done, which helps busy witnesses agree to attend in the first place. But warn them not to assume it: if there is any chance of recall or a need to compare their account with another witness, the court can order them to wait, so they should check before leaving. If you may need a witness again later in the same hearing, ask the court to order them to remain rather than risk them going home.
Foire aux questions
Un témoin peut-il partir après avoir témoigné ?
Oui.
