Article 137: Performing a non-money obligation during suit

ในคดีที่เรียกร้องให้ชำระหนี้อย่างอื่นนอกจากให้ชำระเงิน จำเลยชอบที่จะทำการชำระหนี้นั้นได้โดยแจ้งให้ศาลทราบในคำให้การหรือแถลงโดยหนังสือเป็นส่วนหนึ่งต่างหากก็ได้ถ้าโจทก์ยอมรับการชำระหนี้นั้นเป็นการพอใจเต็มตามที่เรียกร้องแล้ว ให้ศาลพิพากษาคดีไปตามนั้น และคำพิพากษานั้นให้เป็นที่สุดถ้าโจทก์ไม่พอใจในการชำระหนี้เช่นว่านั้น โจทก์ชอบที่จะดำเนินคดีนั้นต่อไปได้

English translation

In a case claiming performance of an obligation other than the payment of money, the defendant is entitled to perform that obligation, and may do so by informing the court in the answer or by stating it in a separate writing. If the plaintiff accepts that performance as full satisfaction of the claim, the court shall give judgment accordingly, and that judgment is final. If the plaintiff is not satisfied with such performance, the plaintiff is entitled to continue the case.

Section 137 is the counterpart of Sections 135 and 136 for claims that do not sound in money, such as claims to deliver property or perform an act. It lets a defendant satisfy the obligation during the litigation and put that before the court, either within the answer or by a separate written statement. If the plaintiff treats the performance as full satisfaction, the court gives a final judgment on those terms; otherwise the plaintiff may press on. The provision reflects the Code's general policy in this Chapter of allowing a case to be closed early where the defendant meets the claim and the plaintiff is content.

Why this matters in practice

If you are sued to hand over property, vacate premises, or perform some act rather than pay money, this section gives you a clean way to comply and try to end the case, but only a plaintiff who is genuinely satisfied ends it, so how the performance is documented to the court matters. Record the performance carefully, whether in the answer or in a separate filing, so there is no later dispute about whether the claim was met.
