ถ้าบุคคลซึ่งต้องชำระค่าฤชาธรรมเนียมค้างชำระค่าฤชาธรรมเนียมต่อศาลก็ดี หรือต่อเจ้าพนักงานบังคับคดีก็ดี หรือต่อบุคคลอื่นที่มิใช่เจ้าหนี้ตามคำพิพากษาก็ดี ศาล เจ้าพนักงานบังคับคดี หรือบุคคลเช่นว่านั้นอาจบังคับเอาแก่ทรัพย์สินของบุคคลนั้นเสมือนหนึ่งเป็นลูกหนี้ตามคำพิพากษาเพื่อชำระค่าฤชาธรรมเนียมดังกล่าวได้ ในกรณีเช่นนี้ ให้ถือว่าหัวหน้าสำนักงานประจำศาลยุติธรรมชั้นต้น เจ้าพนักงานบังคับคดี หรือบุคคลที่มีสิทธิได้รับค่าฤชาธรรมเนียมนั้น แล้วแต่กรณี เป็นเจ้าหนี้ตามคำพิพากษา

If a person liable to pay court costs is in arrears in paying court costs to the court, or to the executing officer, or to a person other than the judgment creditor, the court, the executing officer, or such person, as the case may be, may enforce against that person's property as if that person were a judgment debtor, in order to recover such court costs. In such case, the head of the office attached to the court of first instance, the executing officer, or the person entitled to receive such court costs, as the case may be, shall be deemed to be the judgment creditor. Enforcement under paragraph one shall be exempt from all court costs of execution; but if any money obtained from the execution remains after payment to the person entitled to receive it, the exempted court costs shall be deducted from that money.

Section 169/1 gives court costs owed to the court system or to certain third parties a self-executing collection route. Where such costs fall into arrears, the court, the executing officer, or the entitled person may enforce against the debtor's property as if under a judgment, and the head of the court office, the officer, or the entitled person is deemed the judgment creditor for that purpose.
