Article 222/12Critères de certification d'une action collective

ในการพิจารณาคำร้องขออนุญาตให้ดำเนินคดีแบบกลุ่ม ให้ศาลจัดส่งสำเนาคำฟ้องและคำร้องเช่นว่านั้นไปให้จำเลย เมื่อศาลได้ฟังคู่ความทุกฝ่ายและทำการไต่สวนตามที่เห็นสมควรแล้ว ศาลจะอนุญาตให้ดำเนินคดีแบบกลุ่มได้ต่อเมื่อเป็นที่พอใจแก่ศาลว่า
(๑) สภาพแห่งข้อหา คำขอบังคับ และข้ออ้างที่อาศัยเป็นหลักแห่งข้อหาของโจทก์และของกลุ่มบุคคล มีลักษณะตามที่กำหนดไว้ในมาตรา ๒๒๒/๑๐
(๒) โจทก์ได้แสดงให้เห็นถึงลักษณะเฉพาะที่เหมือนกันของกลุ่มบุคคลที่ชัดเจนเพียงพอ เพื่อให้รู้ได้ว่าเป็นกลุ่มบุคคลใด
(๓) กลุ่มบุคคลมีสมาชิกกลุ่มจำนวนมาก ซึ่งการดำเนินคดีอย่างคดีสามัญจะทำให้เกิดความยุ่งยากและไม่สะดวก
(๔) การดำเนินคดีแบบกลุ่มจะเป็นธรรมและมีประสิทธิภาพมากกว่าการดำเนินคดีอย่างคดีสามัญ
(๕) โจทก์ได้แสดงให้เห็นว่าโจทก์เป็นสมาชิกกลุ่มที่มีคุณสมบัติ ส่วนได้เสีย รวมตลอดทั้งการได้มาซึ่งสิทธิการเป็นสมาชิกกลุ่ม ตามข้อกำหนดของประธานศาลฎีกา ถ้ามี และโจทก์รวมทั้งทนายความที่โจทก์เสนอให้เป็นทนายความของกลุ่มสามารถดำเนินคดีคุ้มครองสิทธิของกลุ่มบุคคลได้อย่างเพียงพอและเป็นธรรม
คำสั่งศาลที่อนุญาตให้ดำเนินคดีแบบกลุ่ม ศาลอาจจำกัดขอบเขตของกลุ่มบุคคลให้ชัดเจนเพียงพอ เพื่อให้รู้ว่าเป็นกลุ่มบุคคลใดก็ได้
คำสั่งอนุญาตหรือไม่อนุญาตให้ดำเนินคดีแบบกลุ่มอาจอุทธรณ์ไปยังศาลอุทธรณ์ภายในกำหนดเวลาเจ็ดวันนับแต่วันที่ศาลมีคำสั่ง และให้งดการพิจารณาไว้จนกว่าคำสั่งนั้นจะถึงที่สุด ทั้งนี้ ให้ศาลอุทธรณ์วินิจฉัยชี้ขาดโดยเร็ว คำวินิจฉัยของศาลอุทธรณ์ให้เป็นที่สุด
ในกรณีที่ศาลมีคำสั่งอนุญาตให้ดำเนินคดีแบบกลุ่ม ให้ศาลสั่งรับคำฟ้องไว้พิจารณาเมื่อได้ส่งหมายเรียกให้จำเลยแล้ว ให้จำเลยทำคำให้การเป็นหนังสือยื่นต่อศาลภายในหนึ่งเดือนและให้ถือว่าทนายความของโจทก์เป็นทนายความของกลุ่มด้วย
ในกรณีที่ศาลมีคำสั่งไม่อนุญาตให้ดำเนินคดีแบบกลุ่ม ให้ศาลดำเนินกระบวนพิจารณาต่อไปอย่างคดีสามัญ

English translation

In considering a motion requesting permission to proceed as a class action, the court shall send a copy of the complaint and of such motion to the defendant. When the court has heard all parties and conducted an inquiry as it deems appropriate, the court may permit the class action only when it is satisfied that:
(1) the nature of the claim, the demand for relief, and the allegations relied upon as the basis of the claim of the plaintiff and of the group of persons have the characteristics prescribed in Section 222/10;
(2) the plaintiff has shown the common specific characteristics of the group of persons clearly enough to identify which group of persons it is;
(3) the group of persons has a large number of members, such that conducting the case as an ordinary case would cause difficulty and inconvenience;
(4) the class action would be fairer and more efficient than conducting the case as an ordinary case;
(5) the plaintiff has shown that the plaintiff is a group member possessing the qualifications and interest, including the acquisition of the right to be a group member, in accordance with the regulations of the President of the Supreme Court, if any, and that the plaintiff together with the lawyer whom the plaintiff proposes as lawyer of the group can conduct the case to protect the rights of the group of persons adequately and fairly.
In an order permitting a class action, the court may limit the scope of the group of persons so as to be clear enough to know which group of persons it is.
An order permitting or not permitting a class action may be appealed to the Court of Appeal within seven days from the date the court issues the order, and the proceedings shall be stayed until such order becomes final. In this regard, the Court of Appeal shall decide promptly. The decision of the Court of Appeal shall be final.
In the case where the court issues an order permitting a class action, the court shall accept the complaint for consideration once the summons has been served on the defendant. The defendant shall make a written answer and file it with the court within one month, and the plaintiff's lawyer shall be deemed the lawyer of the group as well.
In the case where the court issues an order not permitting a class action, the court shall proceed further as an ordinary case.

Section 222/12 is the certification gateway of the class action regime. It requires the defendant to be served and heard, and the court to conduct an inquiry, before applying a five part test that mirrors the commonality, numerosity, superiority, and adequacy of representation concepts found in comparable systems. Item (1) ties back to the pleading standard in Section 222/10, and item (5) references any regulations of the President of the Supreme Court on membership. Two features carry major consequences: the court may confine the class definition, and the certification order, whether granting or refusing, is subject to a short seven day appeal to the Court of Appeal, during which proceedings are stayed and whose decision is final. On certification the defendant gets one month to answer, and the plaintiff's lawyer becomes lawyer for the whole group.

Why this matters in practice

Certification decides whether a group claim lives or dies, so this is where the real fight happens. The seven day appeal window is unusually tight, so a party who wants to challenge certification must be ready to move immediately, and the Court of Appeal's ruling ends the argument for good. A refusal does not kill the lawsuit; it simply continues as an ordinary case between the named parties. Because the plaintiff's chosen lawyer becomes counsel for the entire group, the adequacy of that lawyer is itself a certification issue, which makes choosing the right Thai lawyer a strategic decision, not just an administrative one.
