Annotation de l'entreprise

This is the notice provision that gives the class action its due process backbone. Because a class judgment will bind absent members, the law requires both targeted notice to known members and broad public notice by newspaper for three consecutive days, with discretion to add other media. The nine mandatory particulars ensure members learn the essentials: who is suing, what the group is, their rights under Sections 222/16 and 222/17, the binding effect of the judgment, and above all the opt out deadline, which cannot be shorter than forty-five days. The provision works hand in hand with Section 222/14, whose deposit funds this publication.

Pourquoi cela est important en pratique

If you receive a class action notice, or spot one in a newspaper, read it carefully: it tells you whether you fall within the group, what the case is about, and by when you must act if you do not want to be bound. The forty-five day minimum opt out window is your key deadline, and staying in means the judgment will bind you for better or worse. For a plaintiff, publication is a real cost driver, which is why the deposit under Section 222/14 matters. If you are unsure whether a published class action covers your situation, a short consultation with a Thai lawyer can tell you where you stand.

Foire aux questions

How long do group members get to opt out after a class action notice?

The court sets the deadline in the notice, but under Section 222/15(6) it cannot be less than forty-five days from publication.
