traduction anglaise
A group member has the right to opt out of group membership by notifying his intention in writing filed with the court within the period prescribed by the court under Section 222/15(6), and such group member shall be deemed not to be a group member from the date he gave such notice to the court.
When the period under paragraph one has expired, a group member may not opt out of group membership except with the permission of the court, and the court's order shall be final.
A person who has opted out of group membership may not apply to re-enter as a group member.
A group member, and a person who has opted out of group membership, may not intervene as a co-plaintiff in the class action by relying on the right under Section 57.

Annotation de l'entreprise
This provision embodies the opt out model of the Thai class action: membership is automatic for those within the group unless they affirmatively leave. It sets a clean timeline anchored to the deadline in Section 222/15(6), makes leaving before the deadline a matter of right, and leaving after it a matter of the court's final discretion. Two bars follow: no re-entry once out, and no separate intervention as a co-plaintiff under Section 57 by either members or opt outs. The logic is that members already have a bundle of participation rights under Section 222/17, so the ordinary intervention route is closed to prevent the class from fragmenting.
Pourquoi cela est important en pratique
The opt out decision is one of the most consequential choices a group member makes, and it is largely one way. Staying in means the judgment binds you and you cannot later sue separately, while opting out frees you to pursue your own case but forfeits any share of the class result, with no route back. Because leaving after the deadline needs the court's permission and that ruling is final, the safe course is to decide within the published window. If your potential recovery is large or unusual compared with the group, individual litigation may serve you better, and our lawyers can help you weigh that before the deadline runs.
Foire aux questions
How does a group member opt out of a class action in Thailand?
Under Section 222/16 the member files a written notice with the court within the opt out period set under Section 222/15(6). The member is treated as leaving the group from the date of that notice.
Can you rejoin a class action after opting out?
No. Under Section 222/16 a person who has opted out cannot apply to re-enter the group, and cannot join as a co-plaintiff under the ordinary intervention rule in Section 57.
What happens if I stay in the class rather than opt out?
If you do not opt out, you remain bound by the class judgment and cannot bring a separate suit on the same matter, but you keep the participation rights set out in Section 222/17.
