Article 222/22: Default by the defendant

ในกรณีที่จำเลยขาดนัดยื่นคำให้การหรือขาดนัดพิจารณาศาลจะมีคำพิพากษาหรือคำสั่งชี้ขาดให้โจทก์เป็นฝ่ายชนะคดีโดยจำเลยขาดนัดยื่นคำให้การหรือขาดนัดพิจารณามิได้ ให้ศาลสืบพยานหลักฐานโจทก์ไปฝ่ายเดียว และศาลอาจเรียกพยานหลักฐานอื่นมาสืบได้เองตามที่เห็นว่าจำเป็นเพื่อประโยชน์แห่งความยุติธรรม
ถ้าโจทก์ไม่นำพยานหลักฐานมาสืบตามความในวรรคหนึ่งภายในระยะเวลาที่ศาลกำหนด หรือในกรณีที่คู่ความทั้งสองฝ่ายหรือโจทก์ขาดนัดพิจารณา ให้บังคับตามบทบัญญัติมาตรา ๒๒๒/๒๕
นอกจากที่บัญญัติไว้ในวรรคหนึ่งและวรรคสอง ให้นำบทบัญญัติว่าด้วยการพิจารณาโดยขาดนัดมาใช้บังคับโดยอนุโลม
English translation
In the case where the defendant defaults in filing an answer or defaults in appearance, the court may not render a judgment or an order deciding in favor of the plaintiff merely by reason of the defendant's default in filing an answer or default in appearance. The court shall take the plaintiff's evidence ex parte, and the court may itself call other evidence to be taken as it sees necessary for the benefit of justice.
If the plaintiff does not bring evidence to prove the case under paragraph one within the period prescribed by the court, or in the case where both parties or the plaintiff default in appearance, Section 222/25 shall apply.
In addition to what is provided in paragraph one and paragraph two, the provisions on trial in default shall apply mutatis mutandis.

This provision modifies the ordinary law of default for class actions to protect the absent group members. In a normal case a defendant's default can ease the plaintiff's path, but here the court is barred from giving judgment for the plaintiff on the strength of default alone; the plaintiff must still prove the case ex parte, and the court is given an inquisitorial power to summon further evidence for the sake of justice. This heightened scrutiny reflects that a class judgment binds many people who are not before the court. Paragraph two routes plaintiff side or mutual default to Section 222/25, and paragraph three imports the general default provisions mutatis mutandis.
Why this matters in practice
For plaintiffs, do not assume that a silent or absent defendant means an easy win in a class action; you must still put on a genuine evidentiary case, because the court cannot rule for you on default alone and may even call its own evidence. For defendants, ignoring a class action is dangerous but does not guarantee the plaintiff succeeds, so getting proper advice rather than staying away is the sound course.
