traduction anglaise
In the trial and adjudication of the case, for the benefit of justice the court has the power to seek additional facts. In doing so, the court may admit witness testimony, documentary evidence, or other evidence besides the evidence of the parties, but must inform all parties and must not cut off the parties' right to dispute such evidence.
The court may request a qualified person or an expert to give an opinion in support of the trial and adjudication of the case, but must inform all parties and must not cut off the parties' right to request that a qualified person or expert of their own side be called to give an opinion disputing or supplementing the opinion of such qualified person or expert.
A person whom the court has requested under paragraphs one and two has the right to receive a fee, travel expenses, accommodation, and reimbursement of expenses incurred, in accordance with the regulations of the President of the Supreme Court, with the approval of the Judicial Administration Commission. The money the court orders paid under this paragraph shall not be regarded as court fees for conducting the class action that the parties must pay.

Annotation de l'entreprise
This provision gives the class action court an inquisitorial dimension unusual in ordinary adversarial civil litigation. Because a class judgment affects a large, partly absent group, the court is empowered to go beyond party led evidence and actively seek facts, admit its own evidence, and consult experts or qualified persons. The safeguard throughout is procedural fairness: the court must disclose such material to the parties and preserve their right to dispute or rebut it, including by calling their own experts. The final paragraph handles the mechanics, entitling court summoned experts to fees and expenses under Supreme Court regulations and expressly excluding those sums from the parties' court fees.
Pourquoi cela est important en pratique
Litigants should expect a more active judge in a class action than in an ordinary civil case, and prepare for the possibility that the court will introduce its own evidence or expert opinions. The practical protection is your right to be told and to respond, so watch for court initiated evidence and be ready to challenge it or bring a counter expert. This inquisitorial power can cut either way, filling gaps a party has left, so neither side should assume the record is closed once its own case is in. Where technical or valuation questions drive the case, lining up your own expert early is prudent; our litigators can help you scope that.
