Annotation de l'entreprise

This section tailors the ordinary judgment-content rule in section 141 to the class action context by adding what a group judgment uniquely needs to function. The clear group definition in item (2) is essential because it fixes exactly who is bound and who may later claim a share, linking to the certification definition and to the exclusion scenario in section 222/34 paragraph three. Item (3) requires not just a lump-sum award but a transparent formula for distributing money among members, which is what makes collective recovery workable at the execution stage. Item (4) makes the plaintiff's lawyer's reward a stated part of the judgment, tying into the incentive structure in section 222/37. Together these ensure the judgment can actually be administered across a large group.

Pourquoi cela est important en pratique

For members, the two things to check in a class judgment are whether you fall inside the group as defined and how your individual share is calculated, because both determine what you can claim at execution. If the group definition in the judgment is narrower than you expected, that can affect your right to recover, so read item (2) carefully. Defendants should note that a money judgment must spell out both the total and the per-member calculation, which shapes total exposure. Understanding how the distribution formula applies to your situation is a good reason to seek advice before filing a payment request.

Foire aux questions

What must a class action judgment contain?

Under section 222/36 it must include the standard elements from section 141, a clear definition of the bound group or subgroup, the money owed and how each member's share is calculated where money is awarded, and the plaintiff's lawyer's reward.

How is each member's share of a class award determined?

Section 222/36(3) requires the judgment itself to state the criteria and method of calculation for paying money to group members, so the distribution formula is set out in the judgment.
