traduction anglaise
Where the court renders judgment in favor of the plaintiff, the court has the power to fix the criteria, the methods, and the conditions for compliance with the judgment, whether by fixing them in the judgment or by a subsequent order, and during the execution of the judgment the court has the power to issue additional writs of execution to give effect to the judgment as it deems appropriate.
The court of first instance has the power to consider and order on a request for a stay of execution of the judgment. The order of the court of first instance shall be final.

Annotation de l'entreprise
This provision gives the trial court unusually flexible and continuing control over enforcement in class actions, recognizing that group relief often cannot be executed through a single fixed order. It empowers the court to design the criteria, methods and conditions of compliance and to keep issuing supplementary writs during execution, which is well suited to complex, staged, or ongoing remedies affecting many members. The second paragraph concentrates authority over stay-of-execution requests in the court of first instance and makes that court's order final, which speeds enforcement by cutting off appeals on stays. Read with sections 222/35 and 222/39, it shows a design that centralizes and streamlines class enforcement under close judicial management.
Pourquoi cela est important en pratique
The practical message for defendants is that a class judgment is not a static order you can wait out; the court can keep adjusting and adding writs to make enforcement effective, so compliance planning should start early. If you want to pause execution, note that only the court of first instance decides a stay and its ruling is final, so there is no appeal of a refused stay, which makes the first application critical. For the winning group, this flexibility helps ensure the remedy is actually delivered. Given the finality on stays, professional handling of any stay request is important.
Foire aux questions
Can the court change how a class action judgment is enforced?
Yes. Section 222/38 lets the court fix the criteria, methods and conditions for compliance in the judgment or by later order, and issue additional writs of execution during enforcement as it sees fit.
Can you appeal a decision on staying execution in a class action?
No. Under section 222/38 the court of first instance decides a request to stay execution and its order on that request is final, so it cannot be appealed.
