traduction anglaise
When the execution officer has, in another case, seized or attached any property of a judgment debtor on behalf of a judgment creditor, the plaintiff's lawyer in the class action shall have the power to file a request, made in the form of a motion, with the court that issued the writ of execution for the seizure or attachment of that property, so that the court may order a rateable distribution of the property to the plaintiff's lawyer, the plaintiff, and the group members under Section 326, according to the amounts they are entitled to receive.
In the case where the amount of money for which group members have filed debt-repayment claims under Section 222/42 has not yet been finalised, the court that receives the request for rateable distribution under paragraph one shall stay its order for the rateable distribution, and once that amount has been finalised, the plaintiff's lawyer shall notify that court.
Once the court has ordered a rateable distribution, the execution officer in that case shall remit the money to the execution officer in the class action for payment to those entitled under Section 222/44.

Annotation de l'entreprise
This provision extends the ordinary rateable-distribution mechanism in Section 326 to the class action context and gives standing to the plaintiff's lawyer to invoke it. Where the same defendant's assets are being executed against in another case, the class action side can claim its proportionate share rather than lose out to the first creditor to seize. The second paragraph solves a timing problem unique to class actions: because members' individual claim amounts are settled through the Section 222/42 process, the distributing court must stay its order until those figures are final, then act on the lawyer's notification. The final paragraph channels the recovered funds through the class action execution officer so distribution follows the priority order in Section 222/44.
Pourquoi cela est important en pratique
For a class action to recover anything real, the plaintiff's lawyer must track whether the defendant's assets are being executed against elsewhere and file the rateable-share motion in time, or the group can be shut out by faster creditors. The stay in paragraph two means the group's own claim-verification timetable directly affects when money flows, so keeping members' figures on schedule matters. Enforcement across parallel cases is technical work; our enforcement and debt recovery team handles rateable-share applications.
Foire aux questions
Can a class action claim a share of a defendant's assets seized in another lawsuit?
Yes. Under Section 222/43, the plaintiff's lawyer may file a motion with the court that issued the writ of execution to obtain a rateable share of the property under Section 326 for the lawyer, plaintiff, and group members.
What happens if the members' claim amounts are not yet final?
The court receiving the rateable-share request must stay its order until the members' claim amounts are finalised under Section 222/42, after which the plaintiff's lawyer notifies the court so it can proceed.
