traduction anglaise
In selling the property of the judgment debtor by public auction, the execution officer shall proceed as follows:
(1) In selling property consisting of several things, each thing shall be sold separately and in succession, provided that:
(a) the execution officer shall always have power to arrange movable property of small value into lots and sell them by the lot;
(b) the execution officer shall have power to arrange two or more movable or immovable things and sell them together where it can be anticipated that the proceeds of the sale will increase by reason thereof.
(2) In selling immovable property that can be divided into parts, the execution officer shall have power to sell that property in parts where it can be anticipated that the proceeds from the sale of part of the property will be sufficient for the execution, or that the total proceeds will increase by reason thereof.
(3) In selling several things together, the execution officer shall have power to fix the order in which those things are to be sold.
A person having an interest in the execution over the property to be sold may request the execution officer to combine or separate the property, or to sell the property in the order fixed, or may object to the order of the execution officer made under paragraph one. A request under this Section must be made before the day of the auction, but not later than three days from becoming aware of the method of sale. Where the execution officer refuses to comply with such a request or objection, the requester may file a request with the court within two days from the day of refusal, asking for a ruling on the matter. The order of the court shall be final, and the execution officer shall postpone the sale until the court has made an order, or until the period within which the matter may be brought before the court has elapsed.

Annotation de l'entreprise
Section 333 governs the mechanics of how auction lots are arranged within Part 8. It gives the execution officer discretion to sell items singly, to bundle small-value movables into lots, to combine or divide assets, and to fix the selling order, always guided by maximising proceeds or satisfying the debt efficiently. The second paragraph builds in a check: interested persons may request a particular arrangement or object to the officer's decision, but must act before the auction and within three days of learning the method of sale, with a further two days to escalate a refusal to the court. The court's ruling is final and the sale is postponed pending it. The section works alongside Section 331, which sets the overall auction framework.
Pourquoi cela est important en pratique
How lots are grouped can make a real difference to what a debtor's assets fetch and to how much is left after the debt is cleared. If you are a debtor or co-owner who wants land sold in parts, or a creditor who wants assets bundled, raise it with the officer before the auction and within three days of learning the sale method, then escalate to the court within two days if refused.
Foire aux questions
Can divisible land be sold in parts at auction?
Yes. Under Section 333(2) the officer may sell divisible immovable property in parts where the proceeds from part will suffice for the execution or the total proceeds will increase.
How can I object to how the officer groups the auction lots?
You may request a different arrangement or object before the auction and within three days of learning the sale method; if refused, file with the court within two days, and the court's order is final.
