Section 6/1 — Transfer to the Civil Court in the public interest

In a case filed in a court of first instance other than the Civil Court, before the date of settlement of issues, or, where there is no settlement of issues, not less than seven days before the date for taking evidence, if the court before which the case is pending is of the view that the outcome of the case may affect the conservation or maintenance of natural resources or the environment, the collective protection of consumers, or another important public interest, and that transferring the case to the Civil Court would make the trial and adjudication more efficient, the court shall notify the parties and submit its opinion to the President of the Court of Appeal for an order transferring the case to the Civil Court. The order of the President of the Court of Appeal shall be final. A transfer under paragraph one does not affect the proceedings carried out before the transfer order is made, and all proceedings already carried out shall be deemed proceedings of the Civil Court, unless the Civil Court orders otherwise in the interest of justice.

Section 6/1 allows public interest cases to be concentrated in the Civil Court, which has the capacity and expertise for complex matters affecting natural resources, the environment, consumers, or other significant public concerns. Unlike Section 6, which is a defendant's motion, this transfer is initiated by the court itself, on its own assessment, at an early stage: before settlement of issues, or at least seven days before the first evidence date where there is no such settlement. The decision rests with the President of the Court of Appeal and is final. Paragraph two protects continuity by treating proceedings already conducted as proceedings of the Civil Court, subject to the Civil Court ordering otherwise for the sake of justice.

Are steps already taken lost when a case is transferred under Section 6/1?

No. Proceedings carried out before the transfer order are deemed proceedings of the Civil Court and remain valid, unless the Civil Court orders otherwise in the interest of justice.
