ในคดีราษฎรเป็นโจทก์ หากความปรากฏต่อศาลเองหรือมีพยานหลักฐานที่ศาลเรียกมาว่าโจทก์ฟ้องคดีโดยไม่สุจริตหรือโดยบิดเบือนข้อเท็จจริง เพื่อกลั่นแกล้งหรือเอาเปรียบจำเลยหรือโดยมุ่งหวังผลอย่างอื่นยิ่งกว่าประโยชน์ที่พึงได้โดยชอบ ให้ศาลยกฟ้อง และห้ามมิให้โจทก์ยื่นฟ้องในเรื่องเดียวกันนั้นอีกการฟ้องคดีโดยไม่สุจริตตามวรรคหนึ่งให้หมายความรวมถึงการที่โจทก์จงใจฝ่าฝืนคำสั่งหรือคำพิพากษาของศาลในคดีอาญาอื่นซึ่งถึงที่สุดแล้วโดยปราศจากเหตุผลอันสมควรด้วย
English translation
In a case where a private person is plaintiff, if it appears to the court itself, or from evidence which the court has summoned, that the plaintiff has brought the case in bad faith or by distorting the facts, in order to harass or take advantage of the defendant, or with an aim beyond the benefit lawfully to be obtained, the court shall dismiss the charge, and the plaintiff shall be prohibited from filing a charge on the same matter again. The filing of a case in bad faith under paragraph one shall include the plaintiff's intentional violation, without reasonable cause, of a court order or judgment in another criminal case that has become final.
