traduction anglaise

Subject to Section 97, administrative or police officials have the power and duty to execute a criminal warrant that has been delivered or sent to them for execution within their authority. A criminal warrant issued by the court may be delivered or sent to an administrative or police official within the court's jurisdiction as specified in the warrant, or to the chief administrative or police official of the province, district, sub-district, or tambon, who is to execute the warrant. In the latter case, the official who receives the warrant is responsible for executing it, and may execute it himself or order a subordinate official to execute it, or may deliver or send a certified true copy of the warrant to another administrative or police official who has the duty to execute the warrant he has received. If the warrant has been delivered or sent to two or more officials, the officials may execute it separately or jointly.

Annotation de l'entreprise

This provision allocates responsibility for executing criminal warrants among administrative and police officials and, opening with a reference to Section 97, keeps that power within the limits set for territorial authority. It permits a court warrant to be directed either to a specific official in the court's jurisdiction or to a chief official, and it allows execution to be carried out personally, through a subordinate, or by passing a certified copy to another competent official. The provision also confirms that where several officials hold the warrant, they may act separately or jointly, giving practical flexibility to enforcement. It complements Sections 62 to 64, which govern how warrants are communicated, recorded, and returned once executed.

Pourquoi cela est important en pratique

In practice, when a warrant is executed against you it may be carried out by an official other than the one originally named, provided a certified copy was passed to a competent officer, so the executing officer being different is not by itself a defect. What matters is that the officer is acting within his territorial authority and holds a proper warrant or certified copy. If you doubt the officer's authority to execute a warrant against you, note the details and seek advice from a Thai lawyer.
