Where there is a necessity during the investigation or trial, when the investigating officer, the public prosecutor, the warden of the prison, or the officer having the duty to carry out the detention warrant so requests, or when the court deems it appropriate, the court may order that the accused or the defendant be detained in a place other than a prison, as requested by such person or as the court deems appropriate, under the control of the applicant or of an officer as designated by the court. In this regard, the court may fix a period of time as it deems appropriate.
In considering whether to issue an order under paragraph one, the court may conduct an examination, or allow the injured person or the officer concerned with the detention warrant to object, before issuing the order.
The other place under paragraph one must not be a police station or a place for the custody of the accused of the investigating officer, and must have the characteristics prescribed in a ministerial regulation, which must also prescribe the method of control and measures to prevent escape or damage that may occur.
When the court has issued an order under paragraph one, if afterward the accused or the defendant fails to comply with the method or measures under paragraph three, or the circumstances have changed, the court has the power to change the order or to have the detention carried out under the detention warrant.

Section 89/1 gives the court discretion, on request or of its own motion, to order detention of an accused or defendant outside a prison during investigation or trial, where there is necessity, under specified supervision and for a fixed period. It builds in procedural safeguards: the court may examine the matter and hear objections from the injured person or the officer holding the warrant, and the alternative place cannot be a police station or the investigator's custody facility, with characteristics and anti-escape measures set by ministerial regulation. If conditions are breached or circumstances change, the court may revoke and revert to standard detention. It complements the ordinary detention regime under sections 87 and 88 and the imprisonment counterpart in section 89/2.
