ผู้ใดหมิ่นประมาท ดูหมิ่น หรือแสดงความอาฆาตมาดร้ายราชาธิบดี ราชินี ราชสามี รัชทายาท หรือประมุขแห่งรัฐต่างประเทศ ต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึงเจ็ดปี หรือปรับตั้งแต่สองหมื่นบาทถึงหนึ่งแสนสี่หมื่นบาท หรือทั้งจำทั้งปรับ หมายเหตุ: [อัตราโทษ แก้ไขเพิ่มเติมโดยมาตรา ๕ แห่งพระราชบัญญัติแก้ไขเพิ่มเติมประมวลกฎหมายอาญา (ฉบับที่ ๒๖) พ.ศ. ๒๕๖๐]

Whoever defames, insults, or expresses malice towards the sovereign, the queen, the consort, the heir apparent, or the head of a foreign State shall be liable to imprisonment from one to seven years, or a fine from twenty thousand to one hundred and forty thousand baht, or both.

Firm annotation
Three forms of conduct are covered, defaming, insulting, and expressing malice, and the protected persons are a foreign sovereign, queen, consort, heir apparent, or head of State. The penalty of one to seven years, or a fine from 20,000 to 140,000 baht, is materially heavier than for a foreign envoy under Section 134, and the distinction between the two sections is exactly the status of the person targeted. Note that prosecution of offences in this Chapter is subject to a request from the foreign government concerned.

A person who is not the injured party and holds no power of attorney from the injured party has no authority to prosecute an offence charged under Section 133.
A cultural attache of the Iranian embassy sued a newspaper owner for publishing defamatory material about the head of the Islamic Republic of Iran, invoking Sections 133, 134, 135, 326 and 328. The lower courts dismissed the case and the Supreme Court agreed, holding that the plaintiff was not the injured party and had received no authority from the injured party, so he had no power to prosecute.
