Firm annotation

The elements are: (1) an existing court judgment prohibiting the person from entering a specified zone under Section 45; and (2) the person's entry into that zone. Section 45 is the general-part power that allows a court, in addition to the main penalty, to bar an offender from a defined area; Section 194 is the enforcement offense that criminalizes breach of that ban. It sits in the Title on Offences against Judicial Officials because it protects the effectiveness of court orders. Liability depends on the existence and scope of a valid Section 45 zone order.

Why this matters in practice

This offense only arises where a court has actually imposed a Section 45 zone ban as part of a sentence, so the first thing to verify is the existence, wording, and geographic scope of that order. Exposure is modest (up to one year), but a breach can also undermine a suspended sentence or probation tied to the same case. A genuine dispute over whether the person knew of or entered the defined zone is a common factual defense. Anyone subject to a court zone restriction should confirm its exact boundaries and get criminal law advice in Thailand if unsure.
