ผู้ใดกระทำการด้วยประการใด ๆ ให้การสื่อสารสาธารณะทางไปรษณีย์ ทางโทรเลข ทางโทรศัพท์ หรือทางวิทยุขัดข้อง ต้องระวางโทษจำคุกไม่เกินสามปี หรือปรับไม่เกินหกหมื่นบาท หรือทั้งจำทั้งปรับ หมายเหตุ: [อัตราโทษ แก้ไขเพิ่มเติมโดยมาตรา ๔ แห่งพระราชบัญญัติแก้ไขเพิ่มเติมประมวลกฎหมายอาญา (ฉบับที่ ๒๖) พ.ศ. ๒๕๖๐]

องค์ประกอบของความผิด คือ การกระทำที่ทำให้เกิดปริมาณน้ำจนน่าจะเป็นอันตรายแก่การจราจรทางน้ำ โดยการทำลาย ทำให้เสียหาย หรือเปลี่ยนแปลงสิ่งเกี่ยวกับน้ำที่กฎหมายระบุ เช่น ทางน้ำ ร่องน้ำ ฝาย เขื่อน ประตูน้ำ หรือสิ่งที่สร้างเพื่อกั้นหรือระบายน้ำ อันตรายเพียงแค่น่าจะเกิดก็พอ ไม่จำต้องเกิดอุบัติเหตุขึ้นจริง มาตรานี้อยู่ในหมวดความผิดเกี่ยวกับการก่อให้เกิดภยันตรายต่อประชาชน คุ้มครองการเดินเรือและความปลอดภัยทางน้ำ มาตรา 238 กำหนดโทษหนักขึ้นเมื่อเป็นเหตุให้ถึงแก่ความตาย และมาตรา 239 ใช้กับกรณีกระทำโดยประมาท
